1. Booking and Refund Policy:

• A deposit is required at the time of booking to secure your spot. The remaining balance must be paid in full 30 days prior to the commencement of your trip. For trips to Tonga, the full amount is due 90 days prior to the trip. 
• Written notice of cancellation made more than 30 days prior to the trip start date allow you to transfer your deposit to any other available Blue Vagabonds trip. Cancellations made within 30 days of the tour start date may not be eligible for a refund (90 days for Tonga).
• We reserve the right to adjust the price of trips in response to unforeseen circumstances.

2. Acknowledgment of Risk:  Participation in our trips and interacting with wildlife involves inherent risks, including but not limited to encounters with wild animals, variable sea conditions, and physical activities. By booking a tour with us, you acknowledge that you understand and accept these risks and that your participation is entirely voluntary. Blue Vagabonds will not be held liable for any injuries, illnesses, or losses incurred during the tour.

3. Sightings Not Guaranteed: While we strive to provide exceptional experiences and carefully select locations known for marine wildlife, sightings of marine megafauna cannot be guaranteed. These are wild animals in their natural habitats, and their behavior is beyond our control.

4. Travel Insurance: All participants are required to have comprehensive travel insurance that covers medical emergencies, evacuation, trip cancellations, and any activities planned during the tour, including water-based activities. It is the participant’s responsibility to ensure their insurance is adequate for their needs. For diving trips, diving insurance is also the responsibility of the guest. 

5. Health and Fitness Requirements: Participation in our adventures requires a certain level of physical fitness. It is the responsibility of each participant to ensure they are medically fit to join the tour and partake in the associated activities. Participants may be required to sign a health declaration prior to the tour.

6. Compliance with Guides and Local Regulations: For safety and conservation purposes, all participants must follow the instructions of guides and adhere to local regulations regarding interactions with marine wildlife. Failure to comply may result in removal from the tour without refund.

7. Guest Conduct & Removal Policy: Blue Vagabonds reserves the right to remove any guest from a trip at our discretion for inappropriate behaviour, including but not limited to any form of aggression, bullying, sexual misconduct and other inappropriate actions toward staff, locals, guests, or wildlife, with all associated costs being the sole responsibility of the guest.

8. Changes or Cancellations by Blue Vagabonds: In very rare cases, weather conditions, safety concerns, or other unforeseen circumstances may require us to alter scheduled tours. If such changes occur, we will provide alternatives or refunds as outlined in our cancellation policy. Blue Vagabonds is not responsible for additional expenses incurred by participants due to such changes.

9. Liability Waiver: By participating in our tours, you agree to release, indemnify, and hold harmless Blue Vagabonds, its employees, agents, and affiliates from any claims, damages, or liabilities arising from your participation.

10. Guest Responsibility for Damages: Any damage caused by a guest to property during the trip must be fully covered by the guest. Blue Vagabonds is not liable for any loss or damage caused by guests.

11. Use of Images and Media: We may capture photographs or videos during tours for promotional purposes. By joining our tours, you consent to the use of your likeness in such materials unless you explicitly request otherwise in writing.

12. Dispute Resolution: These terms and conditions are governed by the law of Australia and any disputes hereunder shall be resolved in the courts of Australia.
